A. Defined Terms

App means any mobile application provided by Rego History through which Services are made available.

Rego History means Rego History Pty Ltd including its successors, affiliates, employees, agents, contractors, officers and representatives.

Rego History Report means, in relation to a Vehicle, a report that may include both an Inspection Report and a Car History Report.

Car History Report means a report that contains information about the history of a Vehicle obtained from government registers and third party data providers.

Inspection means a pre purchase visual assessment of a Vehicle, carried out by an inspector appointed by Rego History, and may include a limited road test if considered safe.

Inspection Report means the written results of an Inspection.

Inspector means a qualified mechanic or assessor engaged by Rego History to undertake Inspections.

Services means the provision of car history reports, inspections and related services made available by Rego History through the Website or App.

Vehicle means the vehicle that is the subject of a Report or Inspection.

Website means www.regohistory.com.au.

You means any person who accesses or uses the Website, App or Services, or permits an Inspection to occur.

B. Terms of Use

1. Application

1.1 These Terms govern your use of the Website, App and Services.
1.2 By using the Website, App or Services, you agree to be bound by these Terms.

2. Services

2.1 Rego History provides reports and inspections to assist customers in making informed decisions when buying or selling used vehicles.
2.2 Reports and inspections are provided for your personal use only and are not transferable.
2.3 Rego History is not a seller, broker or dealer of vehicles and does not guarantee the condition, value or suitability of any Vehicle.

3. Use of Website and App

3.1 You must provide accurate and complete information when booking Services.
3.2 Rego History may collect and use your personal information in accordance with its Privacy Policy.
3.3 You are responsible for maintaining the security of your account details and payment information.

4. Fees and Cancellations

4.1 Fees for Services are displayed on the Website and must be paid at the time of booking.
4.2 If you cancel before an inspection is scheduled, a refund may be issued minus processing fees.
4.3 If you cancel after an appointment has been confirmed with a seller, an administration fee may apply.
4.4 If an inspector attends but cannot complete the inspection for reasons outside Rego History’s control, a cancellation fee may apply.

5. Inspections and Reports

5.1 Inspections are performed by inspectors appointed by Rego History. Rego History ensures inspectors are suitably qualified, but they act as independent professionals when conducting inspections.
5.2 Inspections are non-invasive and visual only. No dismantling of parts, compression testing, or specialist diagnostic procedures are performed.
5.3 Road tests may be carried out at the inspector’s discretion if the Vehicle is safe and lawful to drive.
5.4 Inspections and reports reflect the condition of the Vehicle at the time and place of the inspection only.
5.5 Reports are based on the inspector’s professional opinion. They are not a guarantee of the Vehicle’s future performance or reliability.
5.6 Missed faults – While inspectors follow industry practices, there is no guarantee that every defect or issue will be identified. Rego History is not liable for any fault, defect or issue that was not detected, recorded or disclosed in the Inspection Report.
5.7 Events after inspection – Rego History is not liable for any change, damage, fault or issue that arises with the Vehicle after the inspection has been completed.
5.8 Reports do not constitute a roadworthy or safety certificate and should not be relied on as such.

6. Car History Reports

6.1 Car History Reports are sourced from government and third party databases.
6.2 Rego History does not guarantee the completeness or accuracy of information obtained from third parties.
6.3 Car History Reports reflect information available at the time of the search. Rego History is not responsible for future events or changes after the date of the report.

7. Complaints

7.1 Complaints must be made in writing and include your booking reference.
7.2 Rego History will review complaints and, if required under Australian Consumer Law, may provide a remedy including a refund.
7.3 Liability for any valid complaint is limited to the amount paid for the relevant Service.

8. Intellectual Property

8.1 All intellectual property rights in the Website, App and Services are owned by Rego History.
8.2 You may not copy, reproduce, reverse engineer or distribute any part of the Services without prior written consent.

9. Limitation of Liability

9.1 To the maximum extent permitted by law, Rego History excludes all liability for:

• Any errors or omissions in a Report;

• Any defect or issue with a Vehicle that was not detected in an Inspection;

• Any event or change affecting a Vehicle after the date of a Report;

• Any indirect, special or consequential loss.
  9.2 If Rego History is found liable, liability will be limited to the amount paid by you for the relevant Service.

10. Governing Law

These Terms are governed by the laws of Victoria, Australia. You submit to the jurisdiction of the courts of Victoria.
